1. What Aeolian Is, and Is Not

Aeolian is an educational reference for breathing techniques. It is a wellness and education tool.

Aeolian is not medical software, medical advice, diagnosis, or treatment. Nothing in the App is a substitute for professional medical advice. Always consult a qualified healthcare provider before beginning any breathing practice, especially if you have any medical condition. Never disregard professional medical advice or delay seeking it because of something in the App.

2. Health Notice and Assumption of Risk

Breathing practices can meaningfully affect your body. Certain techniques are not appropriate for everyone. Conditions that may make some techniques unsafe include, without limitation: cardiovascular conditions, high or low blood pressure, epilepsy or seizure disorders, pregnancy, respiratory conditions, panic or anxiety disorders, recent surgery, glaucoma, and retinal detachment.

You agree that:

• You will review the safety information and contraindication warnings presented in the App before practicing any technique.
• You will not practice breath retention or intensive techniques while driving, in or near water, standing, or in any situation where loss of consciousness could cause harm.
• You will stop immediately and seek medical attention if you feel faint or dizzy, experience chest pain, or otherwise feel unwell.
• You practice at your own risk. To the maximum extent permitted by law, you voluntarily assume all risks associated with your use of the techniques described in the App.

Certain advanced techniques in the App require an additional in-app acknowledgment and are intended only for adults (18+).

3. Eligibility and Age

You must be at least 13 years old to use the App on your own. If you are under 18, a parent or legal guardian must review and accept these Terms on your behalf and supervise your use of the App.

Family-oriented features are designed for use by adults together with children under direct adult supervision. The App is not directed to children, and children should not use the App independently.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. We (and our licensors) retain all rights, title, and interest in the App, including all content, design, illustrations, text, and software. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the App except as permitted by law.

5. Purchases

The App is free to download and use in its free tier. A one-time, non-consumable in-app purchase ("Full Access") unlocks the complete App.

• Purchases are made through the Apple App Store and are processed by Apple under its terms. We do not see or store your card details.
• Full Access is a one-time purchase for your personal use. Prices may change for future purchasers; a change will not affect access you have already purchased.
• Access unlocked on a device or account may be subject to that platform's account and device limitations. You can restore a prior purchase from Settings → About.

6. Refunds

See our Refund Policy, which is incorporated into these Terms. Purchases made through the Apple App Store are subject to Apple's refund process; we will assist where we can.

7. Acceptable Use

You agree not to: use the App unlawfully; misrepresent the App's content as medical guidance to others; attempt to bypass purchase or access controls; interfere with the operation of the App; or use the App's content to build a competing product.

8. Privacy

Our Privacy Policy describes what limited information we handle. Aeolian is built offline-first: your practice data and journal stay on your device.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS CONTENT IS SUITABLE FOR YOUR INDIVIDUAL HEALTH CIRCUMSTANCES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY ARISING FROM YOUR PRACTICE OF TECHNIQUES DESCRIBED IN THE APP; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow certain limitations; some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Aeolian from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the App.

12. Dispute Resolution: Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Informal resolution first. Before filing a claim, you agree to contact us at support@aeolianbreath.com and give us 30 days to try to resolve the dispute informally.

Arbitration. Any dispute arising out of or relating to these Terms or the App that is not resolved informally will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. The arbitration will be held in San Diego County, California, or remotely by videoconference at your election. The Federal Arbitration Act governs this section.

Small claims carve-out. Either party may instead bring an individual claim in small claims court.

Class action waiver. DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@aeolianbreath.com within 30 days of first accepting these Terms, with a statement that you opt out of arbitration.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to Section 12, exclusive venue for any court proceeding is the state or federal courts located in San Diego County, California.

14. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the effective date above and, where reasonably possible, by in-app notice. Continued use after changes take effect constitutes acceptance.
